Virginia: High-Risk AI Developer and Deployer Act Passed by General Assembly
In an article published by OneTrust’s DataGuidance, Woods Rogers Cybersecurity & Privacy team members Beth Waller, Ross Broudy, Patrick Austin, and John Pilch provide an overview of the recently passed High-Risk Artificial Intelligence Development and Deployer Act in Virginia. This legislation, which awaits Gov. Glenn Youngkin’s signature, mandates a duty of care to protect consumers from algorithmic discrimination by high-risk AI systems. If and when this passes, Virginia will be the second state to enact an AI law regulating the deployment of high-risk systems, which autonomously make or favor a consequential decision about consumers.
Companies that use such systems will have to complete impact assessments and provide notice to the consumer.
