Tracy is a seasoned litigator with experience defending a wide variety of civil litigation matters, including professional liability, personal injury, wrongful death, breach of contract, defamation and unlawful discrimination claims.

Tracy's representative clients have included individuals, small businesses, large businesses, large hospitals and health systems, institutions of higher education, including teaching hospitals, self-insured entities and insureds of numerous national insurance companies.

Tracy has experience with all phases of litigation, from initial filing through appeal. She has tried multiple cases in state and federal courts throughout Virginia, and handled appeals to the Virginia Court of Appeals, the Virginia Supreme Court and the United States Court of Appeals for the Fourth Circuit.

Keeping clients’ business and personal interests in mind, Tracy has negotiated favorable settlements for many clients, avoiding the time and expense of litigation. She has participated in numerous mediations and other settlement conferences. She is regularly called upon to provide continuing education to other attorneys on a variety of topics, including litigation trends, expert witnesses, discovery practices, mediation, and appeals.

Tracy grew up in Stone Harbor, New Jersey, a small town on a barrier island at the southern tip of the Garden State. She followed in her father's footsteps, attending college in Virginia and graduating from Washington & Lee University School of Law.

Tracy and her husband have two teenage girls who keep them busy attending varsity tennis and equestrian events throughout the year. She enjoys traveling with her family and never passes up a chance to get back to the beach.

Experience

Professional Liability/Medical Malpractice Defense

  • Ongoing defense of large healthcare system in variety of medical malpractice cases involving physicians, fellows, residents, interns, and nursing staff. 
  • Won defense verdicts in multiple trials involving health care providers practicing in Virginia.
  • Secured dismissal of hospital on a motion to strike in case involving an intraoperative fire during elective plastic surgery.
  • Represented emergency room physician and gynecologic oncologist in separate cases that were dismissed with prejudice due to the plaintiffs’ lack of standing.
  • Represented nurse whose case was dismissed based upon a Plea of Sovereign Immunity; the dismissal was upheld on appeal by the Virginia Supreme Court.
  • Defended recently appointed judge in legal malpractice action, securing dismissal of all claims based upon a plea of the statute of limitations.
  • Defended clinical psychologist in cases alleging tortious interference with parental rights; dismissal of the suits in the trial courts was affirmed by the Virginia Supreme Court.


Employment/Business Litigation

  • Defended university in case involving alleged violation of new whistleblower statute, securing dismissal of suit on Plea in Bar.
  • Represented company in case alleging breach of contract and violation of covenant not to compete resulting in verdict for client.
  • Defended national cable company in unlawful discrimination claims arising under Title VII and the ADA.
  • Defended attorney and firm in case alleging defamation, securing dismissal of suit on demurrer.
  • Defended insurance agent in case alleging breach of contract and failure to procure excess under/uninsured motorist coverage following accident involving severe traumatic brain injury to young child.
  • Defended national automobile distributor and local dealer in breach of warranty and fraud actions. The manufacturer was dismissed from the case prior to trial and the case proceeded to trial against the dealer, ending with a defense verdict.
  • Defended motorcycle distributor in lemon law case ending with jury verdict for the defendant. 


Personal Injury Defense

  • Defended national fast-food chain and its employee in personal injury action alleging traumatic brain injuries. A prior case against another defendant resulted in a multimillion-dollar verdict for the plaintiff. The firm's client received a defense verdict at its trial.
  • Defended national crane manufacturer in $75 million electrocution action; the manufacturer was dismissed prior to trial without any payment to plaintiff.
  • Defended trucking company and driver in suit following rear-end collision on Interstate 95. Case settled for less than amount of plaintiff's special damages.
